
TERMS AND CONDITIONS
1. General
These Terms and Conditions govern all services and equipment hire provided by Kians Geo-Link Surveyors. By engaging our services or hiring our equipment, the client agrees to comply with these terms.
2. Services Offered
KGS provides, but is not limited to, the following services:
- Boundary Opening
- Land Subdivision
- Topographic Surveying
- Engineering Surveys
- Control Surveys
- Area Verification
- Land Titling Support
- Title Search
- GNSS Equipment Hire
- Survey Consultation
- Other Geospatial and Land Surveying Services
3. Quotations
- All quotations remain valid for thirty (30) days unless otherwise stated.
- Prices may change due to variations in project scope or unforeseen site conditions.
- Any additional work requested after commencement shall attract additional charges.
4. Payment Terms
- A minimum deposit of 50% of the agreed amount is required before commencement of work unless otherwise agreed in writing.
- The balance shall be paid immediately upon completion of the agreed services.
- Equipment hire fees shall be paid before equipment is released.
- Delayed payments may attract additional administrative charges.
5. Equipment Hire
Clients hiring equipment agree to:
- Use equipment only for lawful surveying purposes.
- Operate equipment carefully and according to manufacturer guidelines.
- Return equipment in the same condition in which it was received.
- Return equipment on or before the agreed date and time.
- Report any malfunction immediately.
6. Loss or Damage
The client shall be responsible for:
- Loss of equipment.
- Theft during the hire period.
- Physical damage caused through negligence or misuse.
- Repair or replacement costs where applicable.
Normal wear and tear shall not be charged.
7. Late Return
Late return of equipment shall attract additional hire charges calculated per day or part thereof until the equipment is returned.
8. Cancellation
- Service cancellations made before commencement may qualify for a refund of any balance after administrative costs.
- Deposits may be non-refundable where preparations or mobilization have already commenced.
9. Client Responsibilities
Clients shall:
- Provide accurate information regarding the land or project.
- Obtain necessary permissions to access private property.
- Ensure safe access to the survey site.
- Inform KGS of any known hazards.
10. Survey Results
Survey results are based on:
- Field observations.
- Available legal records.
- Existing survey control.
- Information supplied by the client.
KGS shall not be responsible for disputes arising from incorrect information supplied by third parties.
11. Title Search
Title search results are based on records available at the relevant land registry on the date of the search.
KGS does not guarantee future changes to land records after the search has been completed.
12. Confidentiality
Client information, survey data, maps, reports, and coordinates shall remain confidential and shall not be disclosed without the client’s consent except where required by law.
13. Liability
KGS shall exercise professional care and diligence in all assignments.
However, liability shall be limited to the value of the services provided and shall not extend to indirect or consequential losses.
14. Health and Safety
KGS reserves the right to suspend field activities where site conditions pose significant risks to personnel or equipment.
15. Intellectual Property
All survey reports, drawings, maps, and digital data prepared by KGS remain the intellectual property of KGS until full payment has been received.
16. Governing Law
These Terms and Conditions shall be governed by the laws of the Republic of Uganda.
17. Acceptance
By signing a quotation, hire agreement, invoice, or accepting services from Kians Geo-Link Surveyors, the client acknowledges that they have read, understood, and accepted these Terms and Conditions.
